Dear Mr. Rosario:

I refer to my letter of Sep 19, 2023 05:54:57 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.

Please be informed that the BIR Form 2316 is a form issued by your EMPLOYER (It is a Certificate). Hence, you may request the said document/s to the issuing company. You must be issued of the copy of the said form on or before January 31 of the succeeding year.

With the EMPLOYER's OBLIGATION to give you the original copy of the form, it is therefore your right to request the said copy from your EMPLOYER. 

While our aim is to provide information whenever possible, in this instance the Revenue District Office (RDO) where your Employer is registered would take longer to provide you the information you have requested. The  concerned RDO have to verify if your employer has submitted to them the List of Employees under Substituted Filing (Annex F). Furthermore, the date of filing should also be given for the RDO to be able to verify at the fastest possible time.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 12, 2023 11:06:05 PM, your request will be closed.
