Dear Mr. Legaspi:

I refer to my letter of Jun 16, 2023 04:54:24 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Requesting 2316 Forms.

Relative to this, kindly provide the following:

Name of Employer/s (For Calendar Year 2020 and 2021);
TIN of Employers;
Registered Address of your Employers;
Your Date of Birth;
Your Address;
Your TIN; and
Your contact number (mobile no.) in case we need to call you for further information.

Your request will be endorse to the Revenue District Office (RDO) where your employers during the period is/are registered. They will provide you the needed documents if your employers has submitted the same in your behalf.

Please be informed also that your request for BIR Form No. 2316 for the Calendar Years 2014 to 2019 cannot be provided by the RDO because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

Response to your request

In reply, please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year (CY) 2014 to 2019 from various employers cannot be granted/provided by the Revenue District Offices (RDOs) because the records of the RDOs on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

For BIR Form No. 2316 for CY 2020 to 2021, your employer is under the jurisdiction of RDO No. 47-East Makati. The usual procedure is that, the RDO will ask for a copy of the "Duly Received Annex F" as proof that your employer came to RDO 47 and have the List (Annex F) and scanned copies of BIR Form No. 2316 of all their employees who availed of the substituted filling was submitted.

We will also be requesting the FOI IT Service Desk to retract your eFOI Ticket Number.
