I refer to my letter of Oct 01, 2020 09:43:59 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR form 2316.

Kindly email to us the complete business name and address of your employer from periods June 2006 to December 2019.and its/their TIN for us to be able to properly endorse your request to the concerned Revenue District Office. Furthermore, please email us another valid ID containing your birthdate, signature and photograph at ana.marie.du@bir.gov.ph, for validation purposes.

Please be reminded that TIN is considered a piece of sensitive personal information that is bounded by the Data Privacy Act of 2012.

Dear Mariel Lustestica,

Greetings!

Thank you for your request dated October 01, 2020 at 09:43 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request:

You requested for a copy of your BIR Form 2316 for the period TY 2011 and 2012.

Response to your request:

After careful consideration, we resolve to deny your request as to the following:   Copy of your BIR Form 2316 for the period TY 2011 and 2012.

This Office does not have the information you have requested (BIR Form 2316) since it was only starting 2015 when the employers were required to furnish the BIR with scanned copies of BIR Form No. 2316.  Your employer was not required to submit copies of 2316 certificates during the period requested.

However, your compensation and withholding tax data was found in the submitted Alphalist of Employees filed by your employer for the taxable years TY 2011 and 2012.  A certification was thus made on the data gathered for your purpose, a scanned copy of which was sent thru email.

For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir. gov.ph.
