Dear Sir/Madam,

Hope you are doing well.

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting one of the employment requirement for my loan. Regrettably, I was not able to ask a copy of my BIR 2316 from my current employer right now and I worked from December 2019 up to the present. 


It would be very much appreciated if you can send me a copy via email as my employment is on the line — I have to submit this on July 1st.

Dear Mr. Fernandez:

I refer to my letter of Apr 14, 2023 01:13:58 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Certificate of Income Tax Withheld on Compensation (BIR Form 2316).

In reply, please be informed - In general, every employer or other person who is required to deduct and withhold the tax on compensation, including fringe benefits given to rank and file employees, shall furnish every employee from whose compensation taxes have been withheld the Certificate of Income Tax Withheld on Compensation (BIR Form No. 2316) on or before January 31 of the succeeding year, or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made.[Section 2.83.1 of RR 3-2002]. 

The duty therefore to provide you a copy of your Income Tax Return/BIR Form No. 2316 in this case for a taxable year rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your BIR Form 2316.

Kindly email your employer's name, employer's TIN and employer's business address and send it to sherry.ann.arcita@bir.gov.ph and indicate in the email subject ticket number #BIR-070970700181, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jul 07, 2023 07:30:41 AM, your request will be closed.

In reply, please be informed that your request for a copy of your BIR Form 2316 endorsed at LT Division-Cebu. In this regard, kindly visit our LT Division-Cebu office located at 10th Floor, 1 Nito Tower, Archbishop Reyes Avenue, Cebu City. 
 Look for Mr. Raniel, Chief of Quality Assurance Section for your request to be processed as this requires a payment of certification fee and documentary stamp tax . You may get in touch with him at (032) 2339820.
