Dear Mr. Sallao:

I refer to my letter of Jun 13, 2023 12:34:16 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period January 1, 2022 to June 1, 2023? Or were you an Individual Earning on Purely Compensation Income from the period January 1, 2022 to June 1, 2023?

If you are an Employee for the period January 1, 2022 to June 1, 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2022 to 2023 that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316. 

BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”

Please coordinate with your employer and ask for the copy of your BIR Form 2316 from the Calendar Year 2022 to 2023 if you have not receive a copy.
