Dear Carme Ann Talaga:
I refer to my letter of Aug 10, 2022 04:36:27 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Copy of Income Tax Return (ITR) and/or BIR Form 2316 Request.
This is to acknowledge receipt of your email requesting for your ITR covering taxable year July 1, 2021 to December 31, 2021. We would like to know
whether you are Mixed Income Earner (MIE)/Under Job Order Contract (JO)/Contract of Service or just an Employee of Aklan Provincial Government (APG) during the taxable year per your request?
As MIE/JO/Contract of Service, it means that you have other source/s of income other than employment with APG or Income is per Contract basis and you are required to file your individual ITR. However, if your source of income is purely compensation from APG, you are covered under substituted filing and filing of ITR is not required. Therefore, your Employer (APG) are required to furnish every employee from whose compensation taxes have been withheld BIR Form 2316 Certificate of Compensation Payment/Tax Withheld on or before January 31 of the succeeding year or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made as proof that your taxes were withheld. This shall serve as your Income Tax Return (ITR).
Please send us specific information you need so that we will be guided in our request as we coordinate your concern to the district office where registered. Kindly email the needed information at sherry.ann.arcita@bir.gov.ph. Indicate the tracking number #BIR-088661204321, to respond.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 03, 2022 01:21:01 AM, your request will be closed.

… And I also received my BIR FORM 2307 for the year July 2021- December 2021 from my employer. Can I use this in applying for VISA instead of ITR?

Response to Request
We been calling your mobile/contact number today August 15, 2022, but it was not successful, to apprised you that you should file your own Annual Income Tax Return- Individuals (BIR form 1701) attaching to the said form your BIR Form 2307. If you missed the April 18, 2022 deadline for the filing of your Income Tax Return (ITR) we would encouraged you to proceed to the Revenue District Office (RDO) where you are registered and ask them to re-compute your income tax due with corresponding penalties for late filing.
