Hello i would like request information regarding this:

1. HOW CAN AN OFW HAVE that kind of documentation for bank purposes?  Specifically Loan Applications. 

2. Any Document that will help OFW to submit to a financial institution replacement for BIR 2316 / 1701.

Greetings!

Thank you for your request dated Jul 29, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for BIR 2316 / 1701 FOR OFW.

Response to your request

In reply, please be informed of the following:

a. Issuance of BIR Form 2316 - if you are an Employee in the Philippines or deriving Income Purely on Compensation within the Philippines, your EMPLOYER is required to issue a copy of your BIR Form 2316 (on an Annual basis) pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

b. Issuance of BIR Form 1701 - shall be filed by individuals who are engaged in trade/business or the practice of profession including those with mixed income (i.e., those engaged in the trade/business or profession who are also earning compensation income) in accordance with Sec. 51 of the Code, as amended.

If the OFW has other income sources within the Philippines (ie. with business), you are required to register the said business at the Revenue District Office (RDO) where registered for you to have your Certificate of Registration (COR). Upon registration, you will be interviewed by a BIR staff in order to determine the appropriate internal revenue tax that you have to pay. A Certificate of Registration (COR) shall be issued to you.
