Dear Mr. Arga:

I refer to my letter of Jun 13, 2023 10:20:56 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Tax.

In your case, BIR Forms 2316 are issued by an employer to its employees. Moreover, the said document is made in triplicate copies. Original copy is given to the employee and said document is duly signed both by the employer and employee. The employer also prepares the list of the employees together with the copy/ies of the said BIR Form/s 2316 as proof that said document is duly submitted to the Bureau.

In connection thereto, it is advised that you may then secure copy of the BIR Form 2316 for the Calendar Year 2022 directly from them, being the issuing party. The document requested contains the signature of the parties concerned, providing you of the documents may violate the Data Privacy Act.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 06, 2023 12:09:59 AM, your request will be closed.
