I would like to request for the Dates of the Demand Letters sent by the BIR to the Marcos Estate Executors during the time of President Arroyo and President B. Aquino respectively. 

It was published previously when the party of then Mayor Isko, the BIR responded that they sent the Demand Letter to the executors of the Marcos Estate last December 2, 2021.

Greetings!

Thank you for your request dated Sep 10, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Date of the Demand Letter to the Marcos Estate.

Response to your request

This refers to your request thru electronic mail dated September 16, 2022 asking for the details of the dates of the Demand Letters sent by this Bureau to the Marcos Estate Executors during the administrations of President Gloria Macapagal-Arroyo and President Benigno C. Aquino III.

In this regard, we regret to inform you that upon inquiry from our Legal Service, we cannot process the said request since it is one for a Sensitive Personal Information as defined under R.A No. 10173 considering that it pertains to the tax return of the estate of the late President Ferdinand Marcos Sr.

Moreover, Section 270 of the National Internal Revenue Code of 1997, as amended, identifies the "unlawful divulgence" rule wherein personnel of the Bureau of Internal Revenue cannot divulge information obtained from the taxpayer's business, income or estate as well as the secrets, operations, style or work or apparatus of any manufacturer or producer, or confidential information regarding the business of the taxpayers.
