Dear Ms. Poblete,

I refer to my letter of Apr 03, 2022 03:31:43 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return.

Kindly clarify if you have already filed your ITR for CY 2021, as i am wondering why you are requesting for a copy. in order for us to provide you a copy of your ITR, you should have filed the same.

However, if you have been employed and your withholding tax has been correctly withheld by your employer, provided that you have only one employer and has been qualified for substituted filing for the taxable year - the Certificate of Withholding (BIR Form 2316) filed by your employer, duly stamped "Received" by the Bureau, shall be tantamount to the filing of the income tax return.

Thus, you may directly request BIR Form 2316 for this year from your employer as it is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jun 27, 2022 05:46:34 AM, your request will be closed.
