Dear Mr. Hallare:

I refer to my letter of Apr 02, 2023 09:52:24 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for a copy of your Income Tax Return and/or BIR Form 2316.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period January 1, 2022 to January 1, 2023? Or were you an Individual Earning on Purely Compensation Income from the period  January 1, 2022 to January 1, 2023?

2.  If Employed, kindly provide your (a) TIN Number, (b) Complete Name of your Employer, (c) Employer’s TIN, and (d) Employer Registered Address for the period January 1, 2022 to January 1, 2023?

3. Withstanding your answer to the first and second query, did you file an Income Tax Return (ITR) and/or BIR Form 2316 for the cited period?

If you are an Employee for the period January 1, 2022 to January 1, 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2022 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

Kindly email the requested information (mentioned in paragraph 2) at sherry.ann.arcita@bir.gov.ph and indicate in the email subject tracking number #BIR-110117426934, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jun 27, 2023 04:14:10 AM, your request will be closed.
