Hi! I'm Banjo S. Laurel, 28, from Calamba, Laguna. Can I ask for 2316 or income tax return copy? I lost mine and I need a copy for my new employment. I resigned on my past company, 1988 Development Corporation last January 2021. I've been hired here in Department of Public Works and Highways this July 2021. Can you help me with this?

Dear Mr. Laurel,

I refer to my letter of Sept. 06, 2021, 11:12:58 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for 2316.

Kindly clarify from your new employer if what they are asking from you is the past year as maybe what they were asking from you is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income for this year from previous employment and your tax liability will be based on your total income for the year.

Furthermore, please be informed that your BIR Form 2316 should have been issued to you by your previous employer, If there is any, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov. 30, 2021, 05:14:11 AM, your request will be closed.

We hope to hear from you at the soonest possible time.
