Hope you are doing well.
I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not able to provide me with my BIR 2316 because I am far from my previous employer. I worked from oct 2022 to August 2023.
It would be very much appreciated if you can send me a copy via email as my employment is on the line — I have to submit this on Oct 15th.

Dear Mr. Epe:
I refer to my letter of Oct 02, 2023 07:04:32 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request of Form 2316.
In reply, please be informed that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316.
BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”
The duty therefore to provide you a copy of your ITR/BIR Form No. 2316 for a taxable year rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.
Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 26, 2023 02:26:47 AM, your request will be closed.

However, I would like to clarify that I no longer have any connection to my previous employer, and unfortunately, all of the email addresses and contact information related to that employment have been deleted due to unforeseen circumstances.
In light of this, I kindly request your guidance on the appropriate steps to obtain Form 2316 without the contact details of my previous employer. Any assistance or alternative procedures you can provide in this regard would be greatly appreciated.
