Dear Ms. Carona,
I refer to my letter of Sept. 18, 2021 10:48:49 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income tax return.
In order for us to work further on your request, we need more information from you regarding your query. Kindly provide us the following details for us to properly endorse your request to the concerned RDO and email it at ana.marie.du@bir.gov.ph as these are sensitive information:
- What ITR did you file from 2017-2020? Was it 1700 or 1701?
- Where did you file your ITR,
- Tax Return Confirmation Receipt (if your ITR were filed online)
Furthermore, please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. Also, (if you have been employed) your BIR Form 2316 should have been issued to you by your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.
However, if you have been an employee whose income tax has been correctly withheld, and has only one employer and has been qualified for substituted filing, the Certificate of Withholding filed by your employer, duly stamped "Received" by the Bureau, shall be tantamount to the filing of the income tax return. You may request Form 2316 from your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, if employment is terminated, on the day on which the last payment of compensation is made.
May you also clarify from your new employer if what they are asking from you is the past year as maybe what they were asking from you is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 13, 2021 08:25:05 AM, your request will be closed.
