Hi! I would like to secure a copy of my BIR 2316.

I tried to contact my previous company via e-mail but no one has responded to me. I haven't tried to physically go to their office since it is still pandemic and I am in province and the office is in Manila. 

May I know if I could get my BIR 2316 via this FOI channel?

Greetings!

Thank you for your request dated Nov 03, 2021 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request
You asked for securing a copy of my BIR 2316.

Response to your request
While our aim is to provide information whenever possible, in this instance this Office does not have the information you have requested as your Form 2316 is yet to be filed next year. 

Furthermore, your new employer is asking from you the current year for them to do the year-end adjustment as they will take into consideration your income from previous employment and your tax liability will be based on your total income for the year. Thus, BIR Form 2316 should have been issued to you by your previous employer, if there is any, as as it is mandated by law that every employer shall issue BIR Form No.  2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made.
