To whom it may concern,

I would like to request a copy of my latest Income Tax Return. My contract with my previous employer has already been terminated since 2018. I have received a letter regarding termination of my contract but I haven't received a copy of my BIR Form 2316.
I need it as proof of employment on the new job that I am applying now. Hoping for your favorable response regarding this matter.

Greetings!

Thank you for your request dated May 18, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Latest Income Tax Return and/or BIR Form 2316.

Response to your request

Please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year 2016 to 2018 cannot be granted by the Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
