Hi I would like to request my record for BIR FORM 2316 covering from September-November 2022 while i was working for the company 24/7.ai coz my new employer is asking me to provide them my form 2316. Thank you.

Dear Mr. Montealegre:

I refer to my letter of Nov 13, 2023 08:36:40 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for BIR FORM 2316.

After careful consideration, you are to coordinate with your EMPLOYER as the same is Mandated to Issue the BIR Form No. 2316 for the Calendar Year (s) 2022, pursuant to Section 83 of the 1997 Tax Code and Section 2 [2.83.1] of Revenue Regulations (RR) No. 3-2002, respectively. 

The EMPLOYER shall furnish each Employee/s with the Original Copies of BIR Form No. 2316 as Proof that your Taxes were Withheld and this will serve as your Income Tax Return (ITR).  EMPLOYER is required to issue BIR Form No. 2316 on or before January 31 of Every Year and On the Day the Last Payment of Compensation is Paid.     
 
 For other concerns and assistance, kindly email vanessa.badeo@bir.gov.ph and indicate in the email subject Reference Number #BIR-169988323343, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 06, 2024 04:02:40 AM, your request will be closed.
