Dear Ms. Acero:
I refer to my letter of Jul 01, 2023 08:59:09 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form No. 2316.
In reply, please be informed that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316.
BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”
The duty therefore to provide you a copy of your ITR/BIR Form No. 2316 for a taxable year rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.
Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year 2022.

I already requested a BIR 2316 from my last employer. But it seems like they don't want to give me one, I think it's because I am terminated because I did not go to work. My last report to work was January 2023. What to do with my problem because my new employer needs my BIR 2316 but my last employer is not responding to my email. Do they have the right to not give me a copy of BIR 2316 because I did AWOL to my last employer?

I refer to my letter of Jul 03, 2023 about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316. In particular, I had requested specific information for you to clarify upon in order for us to proceed with the request.
As we have not received a reply within the 60-day working period since the letter requesting for clarification was sent out, we regret to inform you that this request will be closed as of Sep 25, 2023.
You may wish to submit a new request describing the specific information you are looking for, and we will be able to consider it under the guidelines as stated in Executive Order No. 2.
Your right to request a review
