Hi! I resigned from my employer last November 2014. Is it posible for me to request BIR Form 2316 considering it's been almost 9yrs ago?

Dear Ms. Lota:

Greetings!

Thank you for your request dated Apr 25, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for BIR FORM 2316.

Response to your request

Please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year/s 2010 to 2014 cannot be granted by the Revenue District Office (RDO) where your employer's are registered because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

If you have resigned from your previous work and have submitted your work clearance with your former employers, they are required to provide you your BIR FORM NO. 2316 as this SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”
