Hi BIR,

I'm seeking clear guidance on CGT and DST for preselling condo property transfers. The current guidelines are unclear and inconsistent.

Key Questions:

1. Are preselling condo transfers subject to CGT and DST?

2. Are there exemptions?

3. Why do some DMCI Condo Pasalo transactions qualify for exemptions? What makes it exempted?

I've already checked your website but found no conclusive answers. I'd appreciate a direct and comprehensive response.

In reply, please be informed that Initial assessment of your query tells us that this is an actual case. If so, please make your representations with the BIR Legal and Legislative Division (LLD) since this has tax consequences. The BIR LLD will issue a Memorandum to clarify certain policies and specific guidelines related to the grant of Tax Exemption.
