May I please request a copy of my ITR or form 2316 for FY 2007-2009. I lost all my copies and I find it difficult to request it personally since I'm currently working abroad. Thank you

Dear Mark Oliver Dungog:

I refer to my letter of Jul 02, 2022 02:53:47 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Form 2316.

In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as Substitute  Income Tax Return for Taxable Year/s July 2, 2007 to April 30, 2009, kindly send us the Name of your Employer/s for the covering period, Business Address of your Employer/s and Employer/s Taxpayer Identification Number (TIN). We will try to coordinate and endorse your request to the Revenue District Office (RDO) having jurisdiction over the place of your Employer/s and where they submits their reports.

Please be informed also,  that per record/files of the district office/s for the aforementioned years most likely were already sent to archive for storage as it was more than five (5) years of safekeeping per (RMC 73-2008 ang retention period ng withholding tax certificates)  it will be practical and appropriate for you to refer to your employer and ask for the said copies where it actually originated. 

Email the needed information at sherry.ann.arcita@bir.gov.ph. Please indicate in the subject email tracking number ticket number #BIR-197932017357, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 26, 2022 02:45:20 AM, your request will be closed.

Dear Mark Oliver Dungog,

Greetings!

This refers to your request for a copy of your ITR or Form 2316 for Taxable Years 2007-2009.  Attached is the signed Notice of Denial due to the following reasons:

•	Per initial evaluation from Internal Revenue Integrated System (IRIS) , it was found that Mr. Mark Oliver F. Dungog’s TIN: 223-732-340-000 is registered under RDO No 43-Pasig;
•	You are only registered as Executive Order No. 98-Filipino Citizen and not registered as Local Employee; 
•	Only one ID was submitted;
•	Our district only retains data within 5 years from today due to limited space and per applicable revenue regulations/issuances of the bureau.

Please be informed that you have the right to appeal the decision of the undersigned with fifteen (15) days from receipt of this Notice of Denial. For your further guidance, please refer to the Revised People’s Freedom of Information Manual for the Bureau of Internal Revenue, circularized through Revenue Memorandum Circular No. 14-2022, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
