Dear Ms. Baetiong:
I refer to my letter of Oct 19, 2022 09:27:34 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.
In reply, please allow me to ask if you receive a copy of the BIR Form 2316 or Certificate of Compensation Payment/Tax Withheld For Compensation Payment With or Without Tax Withheld from your Employer? If the answer is no, please coordinate with your employer and ask for the copy of said form from year 2020 to 2021.
Please be informed also, that BIR Form 2316 must be accomplished by your employer for each employee receiving salaries, wages, and other forms of remuneration, indicating the total amount paid and the taxes withheld for the calendar year. It must be issued to the employee on or before Jan. 31 of the succeeding year, or on the day of last payment of wages in case of termination from employment.
This certificate, will serve as your Income Tax Return (ITR) being an employee earning purely compensation income regardless of the amount. You are qualified to “Substituted Filing” of ITR pursuant to Revenue Regulation (RR) No. 2-98 as amended.
Lastly, kindly provide us the following data in order for us to evaluate your requested information:
1. Your Tax Identification Number (TIN);
2. Name of your Employer (CY 2020 to 2021);
3. TIN of your Employer; and
4. Address of your Employer.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jan 11, 2023 06:17:39 AM, your request will be closed.

Response to Request
Your request for the year 2020 is approved. Please see copy of your requested information (BIR Form 2316) sent to the email address you have provided.
However, based on the reason stated below, we resolve to deny your request as to the following information:
Copy of your BIR Form 2316 for the year 2021.
This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2021.
For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
