Hi. Good day. I would just like to request your good office a copy of my BIR FORM 2316 possibly submitted at years 2014 to 2015. I wasn't able to furnish a copy from my previous employer, up until the company was dissolved. I will be using it for re-employment and possible visa application. Dear Jose Ricardo Arlos:

I refer to my letter of Jul 18, 2022 02:44:25 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR FORM 2316.

In this instance, kindly provide us the Name of your Employer for the period of  10-01-2014 to 02-28-2015, Employer Business Address and Employer's Taxpayer Identification Number (TIN) for us to endorse your concern to the Revenue District Office (RDO) where your employer is registered and where they submits BIR reports/returns. Email the needed information at sherry.ann.arcita@bir.gov.ph indicate in the subject email ticket number #BIR-207507558541, to respond.

Please be informed also, that our RDO can deny your request for the following instances, 1.) the RDO does not have custody of the information you requested; 2.) If your employer submitted its employees Form 2316 for the year 2014 to 2015, however, your name was not included in the list of employees that are qualified for substituted filing; 3.) If your Employer has not submitted BIR Form 2316 at the RDO. 

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 10, 2022 02:52:24 AM, your request will be closed.

My former employer was CONVERGYS PHILIPPINES SERVICES CORPORATION with TIN 220866782018. Their office location at that time was in MDC 100 Building, C.P. Garcia (C-5) corner Eastwood Ave., Bagumbayan, Quezon City.

Dear Jose Ricardo Arlos,

Greetings!

Thank you for your request dated Jul 18, 2022 02:44:25 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for BIR FORM 2316.

Response to your request

After due verification of the employer name and TIN provided, records of this office failed to show records from CONVERGYS PHILIPPINES SERVICES CORPORATION.  

The records of this Office instead show another corporation previously bearing the name CONVERGYS PHILIPPINES, INC.  Records of the said corporation were also verified but it failed to show withholding tax remittances under your name and T.I.N.

Further, requests for copies of BIR Form No. 2316 for the years 2014 and below cannot be processed since it was only starting 2015 when the employers were required to furnish the BIR with scanned copies of BIR Form No. 2316.  Your employer was not required to submit copies of the said certificates prior to 2015.
