Dear BIR,

I would like to ask if i can request a ITR 2316 from 2008 to 2023 in case my previous employeer cannot give me the documents that i have required.

Dear Mr. Luayon:

I refer to my letter of Jun 19, 2023 03:40:54 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Requesting for Income Tax Return (ITR) and/or BIR Form No. 2316.

Per our phone conversation today, June 19, you were informed that copies of BIR Form No. 2316 from Calendar Years 2008 to 2019 cannot be provided by the    Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008). 

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

For BIR Form No. 2316 for Calendar Year 2023, that is for submission by your previous employer to the RDO on February 28, 2024.

On the other hand, kindly provide us the following information:

Name of Employers (For Calendar Years 2020 to 2022);
TIN of Employers;
Registered Address of your Employers;
Your Date of Birth;
Your Address;
Your TIN; and
Your contact number (mobile no.) in case we need to call you for further info. 

Kindly email the requested information at sherry.ann.arcita@bir.gov.ph and indicate in the subject email ticket number #BIR-210675334501, to respond.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 11, 2023 07:55:21 AM, your request will be closed.
