Good day. I'd like to request a copy of my ITR for proof of employment.

Dear Ms. Yanson:

I refer to my letter of Aug 10, 2023 03:26:56 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Copy of ITR (BIR 2316).

In reply, please be informed that “ALL EMPLOYERS WITH EMPLOYEES, WHETHER OR NOT THEY ARE MINIMUM WAGE EARNERs (MWEs), ARE REQUIRED TO ISSUE BIR FORM NO. 2316. 

BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”

The duty therefore to provide you a copy of your ITR/BIR Form No. 2316 for a taxable year rests upon your employer. Your “ITR” is your personal document and as such your employer must release said document to you as a matter of right or better yet, if you have your payslips for the said year, you can give the same to help them come out with your form 2316.

Kindly coordinate with your employer if you have not receive a copy of your BIR Form 2316 for Calendar Year (CY) 2018 to 2021.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 02, 2023 02:03:40 AM, your request will be closed.

I worked at a hospital from 2018-2019. I'd like to clarify if I can still request from them a copy of my ITR even if I resigned 4 years ago? Thank you very much.

Response to your request

Dear Ms. Sharielle:

This refers to your request which was course through the electronic freedom of Information (eFOI) portal for a copy of your BIR Form No. 2316 from Calendar Year 2018 to 2019.

Please be informed that copies of BIR Form No. 2316 issued from the Calendar Years 2018 and 2019 are no longer available at the Revenue District Offices (RDOs) because it was already beyond the retention period of documents per Revenue Memorandum Circular (RMC) No. 73-2008.

Hence, you may ask for a copy/copies of your BIR Form No. 2316 to your previous employer (s), because All Taxpayers are required to preserve their accounting records for the period of ten (10) years in accordance with the RMC No. 29-2019.
