Dear Edmond Alvin Santos:

I refer to my letter of Aug 10, 2022 07:12:01 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return (ITR) and/or BIR Form 2316.

This is to acknowledge receipt of your email requesting for your ITR covering taxable year January 1, 2020 to December 31, 2021. We would like to know 
whether you are Mixed Income Earner (MIE)/Under Job Order Contract (JO)/Contract of Service or just an Employee during the taxable year per your request? 

As MIE/JO/Contract of Service, it means that you have other source/s of income other than employment or Income is per Contract basis and you are required to file your individual ITR. However, if your source of income is purely compensation, you are covered under substituted filing and filing of ITR is not required. Therefore, your Employer are required to furnish every employee from whose compensation taxes have been withheld BIR Form 2316 Certificate of Compensation Payment/Tax Withheld on or before January 31 of the succeeding year or if employment is terminated before the close of such calendar year, on the day on which the last payment of compensation is made as proof that your taxes were withheld. This shall serve as your Income Tax Return (ITR).

Please send us specific information you need so that we will be guided in our request as we coordinate your concern to the district office where registered. During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 03, 2022 01:45:50 AM, your request will be closed.
