Hi!

I would like to secure a copy of my BIR 2316 for the year 2016 from my past employer. I have been liaising with them over the past few weeks, and they cannot provide me with a copy despite their diligence

They found a pdf that could be the form, but it was password protected, and the person in charge has already resigned and cannot be contacted.

Thank you for your request dated May 24, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

You asked for BIR 2316 from 2016 -- Employer cannot find document despite diligence.

Response to your request

In reply, please be informed that your request for a copy of your BIR Form No. 2316 for the Calendar Year 2016 cannot be granted by the Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Your employer for Calendar Year 2016 are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
