Good Evening Ma’am/Sir,

Is there any way I can request for a copy of my previous BIR form 2316? My last local employment was in 2015 and I worked overseas ship based from Oct 2015 to Dec 2023. Seafarers salary were non taxable so I had to tax payment during these years. I am no longer able to request from my previous employer which is Star Cruises since the company already filed for bankruptcy during pandemic. I decided to stay in the Philippines for good and found a local employer but 2316 is one of my requirements.

Please let me know if there is anything else you need from my side.

You asked for BIR FORM 2316.

Response to your request

Please be informed that your request for a copy/copies of your BIR Form No. 2316 for the Calendar Year 2013 to 2015 cannot be granted by the Revenue District Office (RDO) because the records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
