Hi I would like to request a copy of my ITR for year 2018 and 2019 from my previous employer DM CONSUNJI INC., I will be using the document in applying to other company as it is required. thank you very much and hope you can help me.

Dear ms. Peralta,

I refer to my letter of Nov 15, 2021 03:44:57 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR FORM 2316.

Kindly clarify from your new employer if what they are asking from you is the BIR form 2316 for previous years as maybe what they were asking is the BIR Form 2316 for the current year? 

Please be informed that your new employer will ask you for the BIR Form 2316 for the current year for them to do the year-end adjustment as they will take into consideration your income from previous employment and your tax liability will be based on your total income for the year. Thus, we would like to advise that you better ask for a copy of your 2316 directly from your employer as they are the main source of such documents. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 07, 2022 08:30:01 AM, your request will be closed.
