Dear Mr. Mendoza:

I refer to my letter of Oct 16, 2023 07:19:34 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for JOURNEY  MENOZA BIR FORM 2316(w2) /1701.

In reply, please be informed of the following:

1. Do you have a registered business for the period of 2018 to 2023, then you are required to file your own Income Tax Return either BIR Form 1701 and BIR Form 1701A based on your Certificate of Registration (COR); or

2. Are you an employee for the period of 2018 to 2023, your EMPLOYER is required to issue a copies of your BIR Form 2316 for Calendar Year/s 2018 to 2023 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).
