My previous company for almost 5 years said they don't have a copy of my BIR Form 2316 from 2013 to 2017. Here's a reply from them. 


Good evening.

Please be informed that we do not keep copies of employees' 2316. FATD only provides a copy directly to the employee and a copy submitted to BIR. 

Kindly be advised also that we can no longer accommodate additional requests apart from what was earlier provided to you (COE and Reference Letter) last February 3 in connection with your previous employment with FETP. This is in compliance with the company's Resignation Policy.

I refer to my letter of Nov 27, 2021 09:10:25 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In order for us to properly endorse and work further on your request, kindly provide us your employer’s TIN, RDO no., business name & address, from 2013-2017 and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Feb 18, 2022 11:31:35 AM, your request will be closed.

NOTICE OF DENIAL BY THE FRO

Dear Sir/Ma’am:

	This is in connection with your request for information, with reference number BIR-245071606586, for the following: BIR Form NO. 2316 from 2013 to 2017.

	After careful consideration, we resolve to deny your request due to the following reason/s:

The form of the request is incomplete.
*No transmittal of Form 1604CF with alphabetical list of employees, if manually filed.  Otherwise, proof that the same was submitted online, thus request for details can be with National Office.
*Other Notes:  The document requested are BIR Forms No. 2316 from 2013 to 2017.  Please be informed that in order for this Office to be able to address your concern accurately, we need the following details:
1.	 Name of employer (not abbreviation) and TIN – this is for verification purposes as to the registry of the said employer.
2.	We need to determine whether submission was made thru eSubmission or manually
a.	 If done through online submission, we need to make a request with the National Office Data Center for the said details because all submissions are submitted to BIR’s Data Center
b.	If done manually, such request will be forwarded to Revenue Region No. 8B Administrative Division because all documents of similar character are forwarded to Administrative Division for archive after three (3) years from date received.  Moreover, for this to be done efficiently, we require transmittal of BIR Form No. 1604CF for each year with attached alphabetical list of employees from the subject employer to make sure that your 2316 was submitted to this Office.  

Please be informed that you have the right to appeal the decision of the undersigned.  For your guidance, please refer to the Revised People’s Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau’s Official Website or www.bir.gov.ph.  Thank you for availing our services.
