Dear Ms. Arcangel:
I refer to my letter of Jun 08, 2023 12:54:31 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form 2316.
In order to identify or locate the requested information, we are seeking for further clarification specifically:
1. Did you have a Registered Business between the period June 1, 2018 to June
08, 2023? Or were you an Individual Earning on Purely Compensation Income
from the period June 1, 2018 to June 08, 2023?
2. Withstanding your answer to the first and second query, did you file an ITR
for the cited period of June 1, 2018 to June 08, 2023?
As an added note/reference, if you are an Employee for the period June 1, 2018 to June 08, 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Years 2018 to 2023 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).
Kindly coordinate with your employers if you have not receive a copy of your BIR Form 2316 for Calendar Years 2018 to 2023. Per Revenue Memorandum Circular (RMC) No. 29-2019 All Taxpayers (including your employers) are required to preserve their accounting records for the period of 10 years.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Aug 31, 2023 06:17:08 AM, your request will be closed.
