Thank you for your request dated Jan 05, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR FORM 2316.

We received your request on Jan 05, 2023 and will respond on or before Jan 26, 2023 12:39:56 PM, in accordance with the Executive Order's implementing rules and regulations.

Please be informed of the following, pertaining on your request for a copies of your BIR Form 2316:

1. For Taxable Years 2014 to 2018 under various employers namely: National Housing Authority, Sta. Maria Industrial Park Corporation and Quantus Business Services Inc. 

Please be informed that such request cannot be granted by the Revenue District Office (RDO) where such employers are registered since the aforesaid BIR Withholding Tax Certificates were issued in 2014 to 2018 and records of the RDO on those periods are already unavailable since we follow strictly the four (4) year retention period based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

Hence, you may ask your previous employer/s for the copy/ies of your Certificate of Compensation Payment/ Tax Withheld (BIR Form 2316) because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.

2. For Taxable Year 2018 to 2019 under DM Wenceslao & Associates - The same shall be referred to the BIR- Regular LT Audit 3 (RLTAD 3) for consideration and appropriate action; and

3. For Taxable Year 2019 to 2020 under Sta. Clara International Corporation - It was also referred to the RLTAD 3 office and has provided you a copy for 2019. and your 2020 was provided by your employer.

However, based on the reason stated below, we resolve to deny your request for the year 2019:

We regret to inform you that your request cannot be processed because your employer failed to submit a CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2019.
