I refer to my letter of May 04, 2021 08:55:38 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Certificate of Compensation Payment Tax / Withheld (BIR form 2316).

In order for us to work further on your request, we need more information from you regarding your query. We need the name/s of your employer/s during those years 2011, 2012, and 2018 so that we can verify if indeed we have the custody of the data you are asking for.
            I am sorry I have not replied to you last week since I went home to the province to celebrate Eidl Fitr. And the chief collection section failed to follow my instruction to reply to you regarding your request.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 25, 2021, your request will be closed.

            We already forwarded your request to RDO 44 Taguig for 2011 and 2012 form 2316 via email and we also notified thru our phone conversation more than a week ago. We will also forward your 2018 form 2316 request to the Large Taxpayer Division since we already can confirm that we don't have your requested documents even if your employer's office is located in Makati but your employer is under the jurisdiction of Large Taxpayer.

Please note that we are only able to provide some of the information you have requested for as only BDO Unibank, being one of the large taxpayers, is under our jurisdiction.

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to ltad@bir.gov.ph. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
