Hi. I would like to seek your help in getting a copy of my BIR 2316 for year 2011, 2017,2018, and 2021 as my first employer have physically restructured and old documents was misplaced and wasn't digitalised and my second employer refused to give me a copy of my own 2316 when I requested for it, probably for reasons that they did not want to see their archives. These documents will be used for working visa application.

Dear Ms. Gonzales:

I refer to my letter of Dec 16, 2023 06:01:25 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Copy of Income Tax Return and/or BIR Form No. 2316.

This is in connection with your request for information, with reference number #BIR-287856287416, for the Request of BIR Form No. 2316 for the Calendar Year  (s) 2011, 2017, 2018 and 2021.

In reply, please be informed that the Revenue District Office (RDO) has no physical copies of the submitted BIR Form No. 2316 received from your employer (s); and Records/files of BIR Form No. 2316 for the Year (s) 2011, 2017 and 2018 were already sent to Archive as it was more than four (4) years of Retention Period per Revenue Memorandum Circular (RMC) No. 73-2008.

Hence, you may ask for a copy/copies of your BIR Form No. 2316 to your previous employer (s), because All Taxpayers are required to preserve their accounting records for the period of ten (10) years in accordance with the RMC No. 29-2019.

The Available Documents at the RDOs are from Calendar Year (s) 2020 up to 2022.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 11, 2024 04:12:59 AM, your request will be closed.
