I refer to my letter of Dec 28, 2023 01:33:35 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Bir 2316 year 2017 2018.

In reply, records and/or files of the Revenue District Offices (RDOs) of BIR Form No. 2316 for the Year (s) 2017 to 2018 were already sent to Archive as it was more than four (4) years of Retention Period per Revenue Memorandum Circular (RMC) No. 73-2008.

Hence, you may ask for a copy/copies of your BIR Form No. 2316 to your previous employer (s), because All Taxpayers are required to preserve their accounting records for the period of ten (10) years in accordance with the RMC No. 29-2019.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Mar 21, 2024 07:39:28 AM, your request will be closed.

Thank you for your request dated Dec 28, 2023 01:33:35 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for Bir 2316 for the year 2018.

Response to Request

Based on the reason stated below, we resolve to deny your request as to the following information:   Copy of your ITR for the year 2018.

This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2018.  

After careful consideration, however, since your TIN and name is included in the Alphalist of Employees by your employer for the year 2018, we resolve to grant your request but only up to the compensation and withholding tax information found therein.
