Good day Ma'am/Sir

I am writing in through this website to request and hopefully receive a copy of my BIR 2316 form. This is for the purpose of submitting one of the employment requirement for my new employer. Regrettably, my previous employer is not able to provide me with my BIR 2316 because the company is already closed. I worked from May 2023 to October 2023


It would be very much appreciated if you can send me a copy via email deritneil68@gmail.com as my employment is on the line — I have to submit this on Nov. 20

Greetings!

Thank you for your request dated Nov 16, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your request

You asked for Request copy of BIR Form No. 2316.

Response to your request

In reply, please be informed that the BIR Form No. 2316 for Calendar Year 2023 has not yet been submitted by your Employer  in the Revenue District Office (RDO) because the taxable period has not yet elapsed/finished. 

The RDO gets a hold of the said BIR Form 2316 upon submission of your employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2024.

However, it is advisable that the BIR Form No. 2316 has been provided to you by your previous employer since your employment with them has been terminated/ended.

 Per Section 6 of Revenue Regulations (RR) No. 10-2008 provides that it is the responsibility of the EMPLOYER to furnish the employee his/her BIR Form 2316 on or before January 31 of the succeeding calendar year, or if the employment is terminated before the close of such calendar year, on the day of which the last payment of compensation is made.
