Dear Mr. Fernandez:

I refer to my letter of Sep 22, 2023 09:31:05 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period August to September 2023? Or were you an Individual Earning on Purely Compensation Income from the period August to September 2023?

2. Withstanding your answer to the first and second query, did you file an ITR for the cited period August to September 2023?

As an added note/reference, if you are an Employee for the period August to September 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for aforesaid year pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

However, you may wish to contact/coordinate with your employer in case your employment with them has been terminated/ended per Section 6 of Revenue Regulations (RR) No. 10-2008 provides that it is the responsibility of the EMPLOYER to furnish the employee his/her BIR Form 2316 on or before January 31 of the succeeding calendar year, or if the employment is terminated before the close of such calendar year, on the day of which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 18, 2023 02:02:59 AM, your request will be closed.
