Good day.

May I request of BIR 2316 or ITR. This is my first time to request this form. I work in a private company MG Motor with business address #16 Congressional Avenue cor. San Beda St. Bahay Toro, Quezon City. Our  head office address, Grandcars Inc. Chevrolet Bldg. Brgy. Taft  North, Mandurriao, Iloilo City.

Dear Mr. Licos:

I refer to my letter of Mar 01, 2023 08:57:01 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316.

In reply, we called your mobile number today, March 2, and informed you of the following information on your request for BIR Form 2316 for Taxable Years 2018 to 2022 (not 2023).

BIR Form 2316 for Taxable Year 2018-records of the Revenue District Office on that year is already unavailable since we follow strictly the four (4) year retention period of documents based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).

BIR Form 2316 for Taxable Years 2019-2021 - kindly provide us the TIN of your Employer (Grandcars Inc. and.or MG Motor) for us to coordinate and endorse your request to the RDO where your employer is registered and your TIN Number.

kindly email the needed information at sherry.ann.arcita@bir.gov.ph and indicate in the subject email ticket number #BIR-302658072130, to respond.

Lastly, for BIR Form 2316 for Taxable Year 2022-this should have been provided to you by your employer last January 31, 2023. The submission of the scanned copies of all the BIR Form 2316 and the Notarized Certified List of Employees Qualified for Substituted Filing of ITR per Revenue Regulations No. 11-2018 by your employer last February 28, 2023 to the RDO. It will take time for the RDO to come up with the master list of names for them to be able to grant your request on the aforesaid year.

All BIR Form 2316 should be the responsibility and obligation of your withholding agent (employer) as they are the original source of the document and must release to you as a matter of right.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before May 25, 2023 04:26:15 AM, your request will be closed.
