I would like to request copies of my BIR 2316 forms from 2013 - 2018, under my former employer, OpenText Philippines Inc.
The purpose of this request is that those are required documents in my existing skilled visa application for Australia.

I refer to my letter of Aug 26, 2022 10:31:40 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request for copies for BIR 2316 forms.
In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as a Substitute Income Tax Return for Taxable Year/s 2013 to 2017, Please be informed that per record/files of the district office/s for the aforementioned years were already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, Retention Period of Withholding Tax Certificates. It will be practical and appropriate for you to refer to your employer/s and ask for the said copies where it actually originated.
Kindly send us the Name of your Employer/s for the taxable period of 2018, Employer/s Business Address and Employer/s TIN for us to coordinate and possibly endorse your request to the Revenue District Office (RDO) that has jurisdiction and where your employer/s are registered.
Email the needed information at sherry.ann.arcita@bir.gov.ph as this contains sensitive information and indicate in the subject email tracking number #BIR-319507620675, to respond.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 22, 2022 04:39:20 AM, your request will be closed.

Your Request
You asked for Request for copies for BIR 2316 forms.
Response to Request
Based on the reason stated below, we resolve to approve/deny your request as to the following information:
Copy of your ITR for the year 2013-2014.
We regret to inform you that your request for this period cannot be processed since this Office does not have the information you have requested (ITR). It was only starting 2015 when the employers were required to furnish the BIR with scanned copies of BIR Form No. 2316 and your employer was not required to submit such during the periods requested.
Copy of your ITR for the year 2015-2016
We regret to inform you that your request cannot be processed because your employer failed to submit a CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2015-2016.
Copy of your ITR for the year 2017
Your request for information for the year 2017 is granted. A copy of your requested information was sent to the email address provided.
Copy of your ITR for the year 2018
This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2018.
After careful consideration, however, since your TIN and name is included in the Alphalist of Employees by your employer for the years 2013-2018, we resolve to grant your request but only up to the compensation and withholding tax information found therein. A certification was made on the information gathered for your purpose, a scanned copy of which was sent to the email address provided.
For your guidance, please refer to the Revised People's Freedom of Information Manual for the Bureau of Internal Revenue, which is available for download at the Bureau's Official Website or www.bir.gov.ph.
