hi i would like to request a copy of bir 1701 needed to submit to POEA.  i filed online thru ebirforms last april 8, 2021 under file name 107173146000-1701v2018-122020.xml.  My computer was reformat  so my copy was deleted.  I was not able to have a hardcopy but i have a copy of the Tax Return Receipt Confirmation with me.

Dear Ms. Baluyot,

I refer to my letter of Mar 21, 2022 05:12:36 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 1701.

In order for us to properly endorse and work further on your request, we need more information from you regarding your query. Kindly provide us with the following details for CY 2020 and email them at ana.marie.du@bir.gov.ph. as these contain sensitive information
-Where did you file your ITR, what RDO are you registered with?
-Tax Return Confirmation Receipt (if your ITR were filed online) 

Please be informed that the ITRs that we have in our files are those returns that were filed and paid over-the-counter through our various Accredited Agent Banks; however, for no-payment returns that were filed through our eBIRforms and EFPS system, we do not have the hard copies of these returns on file. 

However, we would also like to suggest that if you know where you filed your ITR, you may directly request it to the concerned RDO, bring the duplicate/xerox copy with you for they may also need to validate and determine if you are the rightful owner of the documents requested as these are sensitive information and are bound by the Data Privacy Act of 2012 and Sec 270 of the NIRC

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jun 14, 2022 02:43:07 AM, your request will be closed.

You asked for bir 1701.

Response to your request

While our aim is to provide information whenever possible, in this instance this Office does not have form you have requested. Verification from the eBIRForms online showed records that the return (BIR Form 1701) was filed. However, the system access that we have is limited to viewing/verifying the Reference numbers (re: FRN) and filing date only. The copy of the return therefore could not be reproduced/printed on our end.

An alternative could be the issuance of certification stating that the said form was duly filed online. Please visit us anytime convenient to you and bring the following requirements:
1. Letter request of taxpayer (state purpose)
2. Tax Return Receipt Confirmation
3. Affidavit of Loss, if applicable
4. Original S.P.A. , if thru representative
5. Government-issued I.D. of taxpayer & representative
