I'm writing this request because I urgently need a copy of my BIR 2316 so I can proceed with my job application with my new employer. I worked from September 29, 2022 until February 17, 2023. Please let me know if you need more information.

Dear Mr. De Guzman:
I refer to my letter of Jan 18, 2024 06:35:48 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Copy of BIR 2316.
In reply, please be informed that you are to coordinate with your EMPLOYER as the same is Mandated to Issue the BIR Form No. 2316 for the Calendar Year (s) 2022 to 2023, pursuant to Section 83 of the 1997 Tax Code and Section 2 [2.83.1] of Revenue Regulations (RR) No. 3-2002, respectively.
The EMPLOYER shall furnish each Employee/s with the Original Copies of BIR Form No. 2316 as Proof that your Taxes were Withheld and this will serve as your Income Tax Return (ITR). EMPLOYER is required to issue BIR Form No. 2316 on or before January 31 of Every Year and On the Day the Last Payment of Compensation is Paid.
As an added information, the RDO does not have yet a copy of BIR Form No. 2316 for CY 2023 because it is due for submission to them by your employer on or before February 28, 2024.

Hello,
I have few questions regarding my rights with BIR 2316 request process with my past employer:
1. Upon request, how many days should my past employer should release my BIR FORM 2316? (I resigned last February 17, 2023 and I just filed for clearance last 16th of January 2024)
2. I need it urgently, can they release it as soon as possible?
