Hi, I would like to ask for a copy of my Income Tax Return from 2018 to 2021.
I ask my previous employer for a copy but unfortunately they don't have a copy.

Dear Mr. Parcasio:
I refer to my letter of Jun 11, 2023 02:17:13 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for INCOME TAX RETURN FORM and/or BIR Form 2316.
In order to identify or locate the requested information, we are seeking for further clarification specifically:
1. Did you have a Registered Business between the period January 1, 2018 to December 31, 2021? Or were you an Individual Earning on Purely Compensation Income from the period January 1, 2018 to December 31, 2021?
2. If Employed, kindly provide the Complete Name of your Employers, Employer’s TIN and Employer’s Registered Address for the period January 1, 2020 to December 31, 2021?
3. Withstanding your answer to the first and second query, did you file an ITR for the cited period?
As an added note/reference, if you are an Employee for the period January 1, 2018 to December 31, 2021, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Years 2018 to 2021 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).
Kindly email the requested information (mentioned in item #2) at sherry.ann.arcita@bir.gov.ph and indicate in the email subject tracking number #BIR-321006269243, to respond.
As an added information, BIR Form No. 2316 issued during the Calendar Period 2018 to 2019 are already unavailable because the Revenue District Office (RDO) follow strictly the four (4) year retention period of documents based on existing revenue issuances of the BIR (Revenue Memorandum Circular 73-2008).
Hence, you may ask your previous employer/s for the copy/copies of your BIR Form 2316 because all taxpayers are required to preserve their accounting records for the period of 10 years in accordance with the Revenue Memorandum Circular No. 29-2019.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Sep 05, 2023 04:15:29 AM, your request will be closed.
