Hi I would like to request for a copy of BIR LM 2316 for the purpose of my General Skill Assessment proof and Visa Migration requirements in Australia.

Thank you for your request dated Dec 06, 2022 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for General Skill Assessment Proof and Migration requirements.
We received your request on Dec 06, 2022 and will respond on or before Dec 27, 2022 02:06:32 PM, in accordance with the Executive Order's implementing rules and regulations.
Please be informed that your request for your BIR Form 2316 for the Calendar Year 2018 to 2021 was endorsed to the Regular LT Audit Division III for consideration and appropriate action.
However, on your request for your BIR Form 2316 for the Calendar Year 2022, it cannot be provided to you yet by the Revenue District Office (RDO) or BIR Office Concerned where your Employer (Converge ICT Solutions, Inc.) is registered because the calendar year is not yet finished/elapsed.
The RDO and/or Other BIR Office Concerned gets a hold of the said BIR Form 2316 upon submission of your employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2023.
You may wish to contact/coordinate with your former employer in case your employment with them has been terminated/ended per Section 6 of Revenue Regulations (RR) No. 10-2008 provides that it is the responsibility of the EMPLOYER to furnish the employee his/her BIR Form 2316 on or before January 31 of the succeeding calendar year, or if the employment is terminated before the close of such calendar year, on the day of which the last payment of compensation is made.

Your request:
You requested for a copy of your BIR Form 2316 for the year 2018-2021.
Response to your request:
Your requested information for the years 2018, 2019 and 2020 has been found and approved for release. A copy of your requested information was sent to the email address you have provided.
However, based on the reason stated below, we resolve to deny your request as to the following information: Copy of your ITR for the year 2021.
This Office does not have the information you have requested (ITR) since your employer failed to include your BIR Form 2316 in the CD submitted for the year 2021.
