I refer to my letter of Sep 16, 2022 11:44:13 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR Form 2316 for the Year 2016-2020.
In connection with your request through eFOI Portal pertaining to the request for a copy of BIR Form 2316 as a Substitute Income Tax Return for Taxable Year/s January 01, 2016 to December 31, 2020.
Please be informed that per record/files of the district office/s for the aforementioned years 2016 to 2017 were already sent to archive for storage as it was more than five (5) years of safekeeping per Revenue Memorandum Circular (RMC) No. 73-2008, Retention Period of Withholding Tax Certificates. It will be practical and appropriate for you to refer to your employer/s and ask for the said copies where it actually originated.
Kindly send us the Name of your Employer/s for the Taxable Year/s 2018 - 2020, Employer/s Business Address and Employer/s TIN for us to coordinate and possibly endorse your request to the Revenue District Office (RDO) that has jurisdiction and where your employer/s are registered.
Email the needed information at sherry.ann.arcita@bir.gov.ph as this contains sensitive information and indicate in the subject email tracking number #BIR-330629149698, to respond.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 09, 2022 05:26:19 AM, your request will be closed.

Your Request
You asked for BIR form 2316 (2016-2020).
Response to Request
As discussed with you over telephone conversation, the Form 2316 will be provided to you by SPMC as your employer. Therefore, this request is now resolved.
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Revenue Officer Robe Ruferos, FOI Receiving Officer. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.
If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
