Dear Ms. SARMIENTO,

I refer to my letter of Sep 25, 2021 02:56:01 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Copy of Income Tax Return (2020).

Kindly clarify from your new employer if what they are asking from you is the ITR for 2020 as maybe what they were asking from you is the BIR 2316 for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.

Furthermore, please be informed that your BIR Form 2316 should have been issued to you by your previous employer, If there is any, as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Dec 20, 2021 03:48:06 AM, your request will be closed.

We hope to hear from you at the soonest possible time.

Hello,

Good day.

Yes, I am requesting for a copy of my BIR 2316 for the year 2020. I received that from my previous employer, but we just printed that out and dropped it in a dropbox for substitute filing. I do not have a personal copy of it. Can I request for a copy of it for pre-employment purposes please?
