Dear Mr. Cheng:
I refer to my letter of Oct 07, 2023 05:41:53 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for INCOME TAX RETURN and/or BIR FORM NO. 2316.
We called your mobile number today, October 9, 2023 to validate your existing eFOI request, however, it was unsuccessful.
In order to identify or locate the requested information, we are seeking for further clarification specifically:
1. Does your father has a Registered Business between the period of January 2022 to October 2023?
2. Or does he (father) an Individual Earning on Purely Compensation Income from the period of January 2022 to October 2023?
3. Withstanding your answer to the first and second query, did he (father) filed an Income Tax Return for the cited period of January 2022 to October 2023?
As an added note/reference, if your father is an Employee for the period of January 2022 to October 2023, his EMPLOYER is required to issue a copy of his BIR Form No. 2316 for aforesaid year of 2022 to 2023 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that his taxes were withheld. This will serve as his Income Tax Return (ITR).
Kindly coordinate with his employer if he have not receive a copy of his BIR Form 2316 for Calendar Year (s) 2022 to 2023 (in case his employment with the company has been terminated/ended before the end of this year).

Hello,
Sorry for not answering the call, I thought it was one of the automated numbers used for scams.
To answer your question:
My father has been an employee for the period of January 2022 until the present, but I think he was not aware/made aware of the BIR Form No. 2316 as a form of ITR.
Hence, I am requesting it on his behalf as we need it urgently and the process with his company to request it is quite lengthy and might need more time.

I can also request it at my nearest BIR Branch if it is much easier and faster, but I would need the requirements to do so, like if I need an Authorization Letter, ID, and the like.

1. Certification of Low Income/No Income signed by the
Barangay Chairman of the place where the applicant
resides; (1 original) - Barangay
2. Duly Notarized Affidavit of Low Income/No Income;
(1 original) - Taxpayer/Notary Public
3. Proof of Payment of P100.00 Certification Fee and
P30.00 loose Documentary Stamp Tax. (1 photocopy) - Collection Section of the Revenue District Office (RDO) having jurisdiction over the place of residence of the taxpayer.
Additional Documents, if applicable to the following cases: If transacting through a Representative:
Special Power of Attorney (SPA) executed by the
taxpayer-applicant; (1 original); and
Any government-issued ID of the taxpayer and
authorized representative; (1 photocopy).
Note: IDs shall be presented and should be readable,
untampered and contains consistent information
with the documents presented upon application.
