Dear Mr.  Mallari:

I refer to my letter of Aug 21, 2023 09:22:45 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Income Tax Return and/or BIR Form No. 2316.

We called your cellphone number today, August 23 to validate your existing eFOI request, however, it was unsuccessful.

In order to identify or locate the requested information, we are seeking for further clarification specifically:

1. Did you have a Registered Business between the period 2022 to 2023? Or are you registered as Professional (Practicing One's Profession and Without Employer/Employee Relationship)  from the period 2022 to 2023?

2.  If Employed (With Employer and Employee Relationship), kindly provide the Complete Name of your Employer, Employer’s TIN and Employer’s Registered Address for the period 2022 to 2023?

3. Withstanding your answer to the first and second query, did you file an ITR for the cited period?

As an added note/reference, if you are an Employee for the period 2022 to 2023, your EMPLOYER is required to issue a copy of your BIR Form 2316 for the aforesaid years pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR).

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Nov 15, 2023 05:56:00 AM, your request will be closed.
