Hi BIR,
I would like to request a copy of my BIR 2316 dated from 2019 to 2021. I was requested by my new employer to submit a copy of BIR 2316 as part of the pre-employment requirements. I have with me only the copy of BIR2316 dated 2018. Any of this period 2019 to 2021 will do. Thank you

I refer to my letter of Jul 12, 2022 05:40:17 PM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Request of BIR Form 2316.
The Certificate of Compensation Payment/Tax Withheld For Compensation Payment With or Without Tax Withheld (BIR Form 2316) SHOULD BE ISSUED by your employer as it is mandated by law that every employer shall issue BIR Form No. 2316 to every employee if employment is terminated before the close of such calendar year, or on the day on which the last payment of compensation is made.
In this instance, kindly provide us the Name of your Employer for the period 01-01-2019 to 12-31-2021, Employer Business Address and Employer's Taxpayer Identification Number (TIN) for us to endorse your concern to the Revenue District Office (RDO) where your employer is registered and where they submits BIR reports/returns. Email the needed information at sherry.ann.arcita@bir.gov.ph indicate in the subject email ticket number #BIR-351349383506, to respond.
During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Oct 05, 2022 03:42:25 AM, your request will be closed.

Response to Request
Your request for a copy of your BIR Form 2316 (ITR) for the year 2020 is granted. A copy of your requested information was sent to you via email.
Based on the reason stated below, we resolve to deny your request as to the following information: Copy of your ITR for the year 2021.
We regret to inform you that your request cannot be processed because your employer failed to submit a CD of scanned copies of Certificate of Compensation Payment/Tax Withheld (BIR Form 2316) for the year 2021.
