Hi, I resigned last oct 21, 2022. I am asking my previous employer if they can give me a copy of BIR form 2316 so that I can submit it to my current employer.

Questions are:
1. What if the processing of the Bir Form 2316 took too long? Is there a timeline that the previous employer should follow? Current Employer told me provide them 2316 asap. 

2. If the current year ended, and I was not able to provide my current employer the Bir form 2316 from previous employer what would happen? Can I file the form 2316 myself? What are the steps?

Greetings!

Thank you for your request dated Nov 09, 2022 10:50:59 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for BIR FORM 2316.

Response to Request

In reply, please be informed that the BIR Form No. 2316 for Calendar Year 2022 has not yet been submitted by your former employer in the RDO because the taxable period has not yet elapsed/finished. 

The RDO gets a hold of the said BIR Form 2316 upon submission of your former employer on or before February 28 (per RR 2-2015 as amended by RR 16-2021) of the following year or in your case on or before February 28, 2023.

Since your employment has terminated last October 21, 2022 you should have submitted BIR Form 2316 from your previous employer to your new employer for consolidation and computation of tax due as against tax withheld to determine the tax still payable, if there are any.  Further, the new employer submits the consolidated BIR Form 2316 to the Revenue District Office (RDO) where they are registered.
